Step 2 - Processing of Millers' & Jaggery License

After obtaining the Letter of Comfort, the next step for establishing a sugar mill or jaggery production facility is to apply for a Millers’ & Jaggery License. This license is essential for the legal operation of the facility, ensuring it meets all regulatory requirements for production and safety.

Requirements for Service:

  1. Certificate of Incorporation:

    • A valid Certificate of Incorporation is required to confirm the legal registration of the business entity seeking the license. This document ensures that the company is officially recognized and operates under the laws of the country.
  2. Form CR 12:

    • This document provides a comprehensive list of the company’s directors and shareholders, issued by the Registrar of Companies. It helps verify the authenticity of the individuals managing and owning the business.
  3. KRA PIN Certificate:

    • The Kenya Revenue Authority (KRA) PIN Certificate is mandatory for all businesses to ensure they are registered for tax purposes. This certificate helps link the business to the tax system and confirms compliance with tax obligations.
  4. Valid Environmental Impact Assessment (EIA) License:

    • A valid EIA License from the National Environment Management Authority (NEMA) is required to demonstrate that the facility has undergone an environmental impact assessment and adheres to environmental protection standards. This ensures that the operations will not adversely affect the environment.
  5. Letter of No-Objection from Respective County Government(s):

    • A no-objection letter from the local county government confirms that there are no local governmental objections to the establishment of the mill or jaggery facility. This letter ensures that the project aligns with local regulations and community standards.
  6. Valid Food Drugs and Chemical Substances (Food Hygiene) Licence:

    • This license, issued by the Ministry of Health, ensures that the facility meets all health and hygiene standards required for food production. It is crucial for maintaining public health and safety standards in the production of sugar and jaggery.
  7. Inspection Report from AFA-Sugar Directorate:

    • An inspection report conducted by the Agriculture and Food Authority’s Sugar Directorate is necessary. This report verifies that the facility meets all regulatory and safety standards and is fit for operation. The inspection ensures that the premises, equipment, and operational practices comply with industry standards.

Application Process:

  • Submission: The application for the Millers’ & Jaggery License is submitted through the Agriculture and Food Authority’s Integrated Management Information System (AFA-IMIS) portal at www.imis.afa.go.ke.
  • Review and Inspection: The Sugar Directorate reviews the submitted documents and conducts a thorough inspection of the facility to ensure compliance with all regulatory requirements. This inspection includes checking the production process, equipment, and safety measures.
  • Approval and Issuance: If the facility passes the inspection and all requirements are met, the Sugar Directorate approves the application. A Millers’ or Jaggery License is then issued, allowing the facility to legally commence operations.

Cost of Service:

  • Sugar Mill License: KSh. 1,000,000
  • Jaggery License: KSh. 50,000

Timeline:

For new applications, the entire licensing process is expected to take up to 60 days.
For renewals, the process is expected to take up to 30 days.
